Finding an Asbestos Lawyer

Brian Bedell

There are many different risk factors in the world today. You can get sick from so many different sources that it is necessary to stay diligent. In many ways it is possible to protect yourself from getting sick. In other circumstances, it is the responsibility of others to protect you from getting sick. This is the case when dealing with harmful materials like asbestos. While asbestos has not been banned in the United States completely, there have been many ways in which asbestos has been recognized as dangerous. It is the responsibility of businesses and building owners to make sure that those who work or live in the environments will either be free of asbestos exposure, or aware of their risk.

When those who are made to be responsible are not doing their part, they need to be held accountable for their actions. This is why it is important that they are brought to court and they are punished for their negligence. This is why it is necessary to be able to find a good asbestos lawyer. Finding a good asbestos lawyer can be difficult as the laws surrounding the issue are not fully clear. To make it even more difficult, there is a difficulty in finding responsibility and fault in those who are in violation. Here are a few tips when looking for this kind of specialized lawyer.

Check with the EPA

The Environmental Protection Agency (EPA) has made it their pursuit to help those who have been exposed to asbestos. While they have tried to ban all materials which contain asbestos, they have been unsuccessful as of yet. They do, however, have a list of great lawyers which will help in representing you if you feel that you may have a case against an employer, landlord or business in your area. These lawyers have an understanding of the risk and what is necessary in order to win a case against these kinds of people.

Building a case

One unfortunate truth is that in most cases it is necessary for someone to be sick or found to be highly at risk of becoming sick because of exposure in order to make a legal case. Proving fault in these cases can be difficult as the process by which people get sick from asbestos usually goes from 10 to 30 years depending on the exposure, the individual and the manner in which the asbestos was introduced into the system. It is the huge gap in time which causes a problem.

Taking immediate action

The most important part of hiring an asbestos lawyer is to make sure to take immediate action in terms of getting laboratory analysis of the area of exposure as well as any documentation in which the matter has been brought to the attention of those at fault. IF there has been any communication in which removing the asbestos has been refused, it is important to preserve this communication so that it can be entered into evidence proving not just neglect, but an insistence to do nothing to prevent exposure.
